Terms & Conditions

 

The Contract

These are the conditions of the contract between you (“The Hirer”) and Eolas Holiday Cottages (“The Owner”). When you book accommodation a contract is made when booking confirmation and your deposit is received by us. The contract confers on you a right to occupy your selected cottage and it's grounds (“The Property”) for a holiday only and does not confer an “assured tenancy” as detailed in the Housing (Scotland) Act 1988.

 

Acceptance of Terms & Conditions

By making a booking you accept the Term and Conditions detailed below on behalf of all members of the party and confirm that:

• You are at least 18 years old at the time of booking.

• You are not booking the Property as part of providing a paid service to a 3rd Party

 

Reservations & Deposits

A deposit of 20% of the full rental is payable when booking with the balance due no later than 6 weeks before the hire start date. If the full balance is not received 6 weeks prior to the hire start date, the deposit may be forfeited and The Property re-let. If the booking is made within 6 weeks of the hire start date then the full amount is required on the booking of The Property.

 

Security Deposit

A £100 refundable security deposit is required at the same time as the full balance in case of:

• damage or loss to the property or its contents
• any excessive cleaning required where the property has been left in a dirty or inappropriate manner

However, The Hirer’s liability to The Owner shall not be limited to this amount and all damages and losses will be charged in full.

 

Payment Details

Payment can be made either by either Electronic Transfer (UK only) or by Credit Card.

 

*The Hirer must ensure they also pay all and any additional transaction fees that may be charged by both the sending and receiving bank for making this payment. If it is found a transaction fee has been deducted from the agreed rental amount by a bank, then the cost of this transaction fee will in turn be deducted from a the Hirer's Security Deposit.

 

 

Cancellations

Once a booking deposit has been paid and the booking confirmed by email or letter, The Hirer is liable for the whole amount of the rental for the period booked. As such it is strongly recommended that The Hirer take out suitable holiday insurance to cover costs incurred by unexpected cancellations, (see liability section below).

In the event of a cancellation the 20% deposit will be forfeited and the following costs will be incurred:

  • 50% refund of balance paid if cancellation is made 3+ weeks prior to arrival date.
  • No refund will be given if cancellation is less than 3 weeks prior to arrival date.

 

 

Availability

The Property will be available from the 16:00 on the booking start date and must be vacated by 11am on the booking end date. Keys will be made available by prior arrangement between The Owner and The Hirer.
If a booking agreement cannot be honoured due to fire, theft or circumstances beyond The Owner’s control and alternative accommodation cannot be offered that is acceptable to The Hirer, then the full amount paid by The Hirer will be refunded. However, The Hirer will not make any claim against The Owner for compensation or expenses.

 

 

Restrictions

The following restrictions apply during The Hirer’s stay at The Property:

  • No smoking allowed anywhere within The Property.
  • The Hirer must not allow anyone in their party to bring other persons onto the grounds other than the original party booked to stay without prior agreement from the Owner.
  • The maximum occupancy as specified in The Property’s details must not be exceeded.
  • The Hirer must not stay beyond the agreed end date/time of their booking.
  • The Hirer may not invite additional persons to The Property.
  • The Hirer must not cause any nuisance or damage to The Property, its neighbours, its grounds or wildlife

The Owner reserves the right to remove person or persons from The Property if any of the above restrictions are violated and in such cases no refunds will be given.

 

 

Personal Property

All vehicles, accessories and contents belonging to the Hirer are left at Property at the Hirer’s own risk. The Hirer is recommended to take out holiday insurance to cover any potential loss or damage.

 

 

Facilities

In the event of a breakdown, The Owner will do everything possible to ensure swift repair/replacement of any appliances or services provided. However, The Hirer accepts that it may be impossible to deal with every eventuality during the course of the booking period. Where the breakdown is determined to be a direct result of misuse, The Hirer will be expected to cover the full cost of repair or replacement.

 

 

Wi-Fi Accessability

Due to our remote location the Broadband connection to the cottages is has a limited speed and download/upload capicity, not comparable to typical broadband services. While this is acceptable for most internet activities such as emailing, surfing and on-line chat, they are not suited to high intensity activities involving large downloads or live streaming.

 

 

Liability

The Owner will not be responsible for any form of compensation to the Hirer for any loss, damage or injury caused by Force Majeure, including, but not limited to, adverse weather conditions, riot, war, strikes, criminal acts, keeping to any law or governmental order, rule, regulation/direction or any other matters beyond their control.

 

The Owner will not be responsible for any harm or injury caused by the natural terrain or flora and fauna within The Property’s grounds or in the surrounding area.

 

The Owner will not be responsible for any harm or injury caused by the misuse of any of the facilities provided at The Property nor any harm caused due to property features such as stairs, ladders, balconies, stoves, fireplaces, etc.

 

The Hirer will be responsible for the health and safety of all members of their party, especially children, whilst staying at The Property and will observe all sensible care and caution required in the use of the provided facilities and when out in the surrounding grounds.

 

Under no circumstances shall The Owner’s liability to The Hirer exceed the amount paid by them for the rental period. This contract shall be governed by Scots Law in every particular including formation and interpretation and shall be deemed to have been made in Scotland. Any proceeding arising out of or in connection with this contract may be brought in any court of competent jurisdiction in Scotland.
